Terms of delivery, payment and business conditions of Feinbeisser Catering & Partyservice
- As we only use fresh produce, we reserve the right to update or replace the range depending on the season.
- The minimum order value is EUR 250.00 net plus delivery.
- The number of persons registered is binding unless the client notifies us 36 hours before the start of the event. This notification can be made by telephone, fax or email. We reserve the right to recalculate in this case.
- The order placement is binding with the offer/order signed by the customer. Verbal collateral agreements do not exist and have not been made.
- Cancellation of the order. If an order that has already been placed is cancelled within 60 days before the start of the event, 100 % of the expected order value will be charged as cancellation costs. For orders in the period from 01 - 31 December within 120 days before the start of the event.
- At the customer's request, the goods can be delivered / collected directly to the building, at ground level, behind the first door. The customer shall ensure that direct truck access (up to 7.5 tonnes) is possible and that the goods can be delivered on wheels and without barriers. Delivery will be charged separately. Unless otherwise agreed, delivery does not include any assembly and dismantling services. For deliveries to upper floors, a flat rate of EUR 15.00 per floor will be charged if no suitable lift is available. A tolerance of 30 to 60 minutes should be allowed for deliveries at a specific time. We reserve the right to make an additional charge. There is no legal claim to delivery in the event of cancellation due to force majeure.
- Deposit. For new customers and private customers, a deposit of 100% of the order value is due 3 working days before the start of the event, or a cash payment on delivery. A subsequent charge for consumption values or breakage and loss of rental items is possible.
- Unless otherwise agreed, the invoice amount is due in cash upon delivery without deduction. If invoiced within 7 days of receipt of invoice.
- Rental items. The rental price for the rental items is valid for a period of 3 days. Loaned items and packaging material remain the property of the company. Only immediate complaints can be considered. Any liability on the part of the hire company for damage to property and personal injury in connection with the hire use is excluded. Misreporting, breakage and damage shall be borne by the customer/client, who shall bear the costs of the necessary replacement at replacement value in addition to the hire charge. The tenant must treat the rented property with care. Crockery, cutlery, kitchen utensils, etc. shall always be cleaned by the hirer upon return. Rented items are to be provided in the transport boxes provided, sorted and ready for removal without any leftover food. The hired items are not insured. The hirer is liable for loss or damage.
- Feinbeisser-Catering accepts no liability for damage to property that occurs during the set-up and dismantling phases and during the event. Liability is transferred to the client when the order is placed.
- Photo and film material. Feinbeisser-Catering creates photo and film material for some events. The customer agrees to the publication. The customer receives a free copy of the pictures taken. If the customer does not agree to the publication of the images, a brief notification to us is sufficient. We never mention customer names, customer addresses etc. in connection with the pictures.
By placing an order, the customer recognises the above terms of delivery and payment as binding. The place of fulfilment and jurisdiction for both parties is Hamburg.
